One specific case example I am proud to share with you is a case this office defended involving the first Vehicular Homicide charged based on marijuana use after Washington voters passed the legalization of marijuana use in the state. Mr. Wood thoroughly evaluated the case, employing an accident reconstructionist, a forensic scientist, and investigator. Through a tremendous amount of hard work, research and legal analysis, Mr. Wood was able to convince the prosecution that they had significant legal issues with proving their case, based upon issues involving the alleged marijuana level in the client’s system, superseding intervening causation, and preparing to challenge the 5 ng THC presumptive impairment law itself. Ultimately, the prosecution agreed to resolve the case for a plea to a misdemeanor DUI charge, based upon numerous legal and factual issues with the case, thus saving the client years in prison and a Class A felony that can never be removed from the client’s record.
